Charges
Market Media Impact Ltd provides services based on predefined project scopes or retainer agreements. Charges are based on the complexity, time, and resources required for execution. Any additional services requested outside of the agreed scope will be subject to further charges, which will be quoted in advance.
Invoicing and payment
Invoices are issued upon project agreement or milestone completion. Payment is due within 14 days unless otherwise agreed in writing. Late payments may incur interest at 5% above the Bank of England base rate. We reserve the right to pause or terminate services if payment is not received.
Client Review
Market Media Impact will provide clients with opportunities to review completed work during key project milestones. Clients are expected to provide timely feedback. Final approval confirms acceptance of the work.
Turnaround Time and Content Control
We strive to meet all agreed deadlines. However, turnaround times depend on prompt client communication and content provision. Delays in content submission may affect delivery schedules. All content and final decisions rest with the client.
Failure to provide required website content
If the client fails to provide required content within 30 days of request, we reserve the right to invoice for work completed and/or place the project on hold. Continued delays may lead to cancellation with no refund.
Web Browsers
Market Media Impact tests websites in modern, commonly used browsers. We cannot guarantee identical performance across all versions or lesser-used browsers unless explicitly agreed.
Termination
Either party may terminate an agreement in writing with 14 days’ notice. Upon termination, the client agrees to pay for all work completed and any non-cancellable expenses incurred.
Indemnity
The client agrees to indemnify and hold harmless Market Media Impact from any claims resulting from their use of our services or breach of these terms.
Intellectual property
All materials created by Market Media Impact remain our intellectual property until full payment is received. Upon full payment, ownership is transferred to the client unless otherwise stated in writing. We reserve the right to showcase completed work in our portfolio.
Confidentiality
We treat all client information with confidentiality and will not disclose any proprietary or sensitive data to third parties without written consent, unless legally required to do so.
Data protection
We handle personal data in accordance with our Privacy Policy and in compliance with the Data Protection Act 2018 and GDPR.
Standard Media Delivery
Final deliverables will be provided in standard digital formats (e.g., PDF, PNG, MP4, HTML). Alternative formats may be arranged upon request and may incur additional charges.
Design Credit and Marketing
Unless otherwise agreed, Market Media Impact may include a small credit link in website footers and use completed designs in marketing materials and case studies.
Post-Placement Alterations
Market Media Impact is not responsible for any changes made to delivered work by third parties or the client. Any repair or recovery work will be chargeable at our standard rate.
Domain Names
We can assist with domain registration and management. However, clients are ultimately responsible for the renewal and management of their domain names unless explicitly included in a service package.
Third Party Products
We may use third-party software or services as part of a project. Market Media Impact is not liable for any limitations, errors, or costs associated with these third-party tools.
General
These terms apply to all services provided unless otherwise stated in a signed agreement. No delay or failure by either party to exercise any right shall be deemed a waiver of that right.
Digital Marketing
Performance results of campaigns are not guaranteed due to variables outside our control. We will, however, use best practices and data-driven strategies to deliver optimal outcomes.
Liability
Market Media Impact shall not be liable for indirect, incidental, or consequential damages. Our total liability shall be limited to the total amount paid by the client under the agreement.
Severability
If any term is deemed invalid or unenforceable, the remaining terms shall continue in full force and effect.
Governing Law and Jurisdiction
These terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
